California's Sweepstakes Casino Ban Has Been in Effect Since January 1 - What AB 831 Actually Says

California's ban on sweepstakes casinos is not coming next year. It is already here, and it has been since January 1, 2026. The state's own codified law is unambiguous: Penal Code section 337o carries the official notation "Added by Stats. 2025, Ch. 623, Sec. 3. (AB 831) Effective January 1, 2026."

That contradicts a claim that has circulated widely in trade coverage: that the ban takes effect January 1, 2027, after a 90-day wind-down period for operators. Neither the 2027 date nor any wind-down appears anywhere in the enacted law.

Where the wrong date came from

AB 831 was approved by Governor Newsom and chaptered on October 11, 2025 as Chapter 623, Statutes of 2025. The bill went through six published versions, from the February 19, 2025 introduced text to the October 11, 2025 chaptered text. None of them contains an operative-date clause, the year 2027, or any 90-day grace period.

When a California statute from a regular session says nothing about its own timing, the default rule in Government Code section 9600(a) governs, and the Legislative Counsel prints the resulting date on the codified section itself. For this law, that official notation reads "Effective January 1, 2026."

Section 9600's default rule does build in a 90-day period, but it is part of the machinery that sets a law's effective date, not a grace period that runs after one. That may be how a "90-day wind-down" entered press coverage. Whatever the origin, the statute itself grants operators no wind-down period of any kind.

What Penal Code 337o prohibits

Section 337o makes it unlawful to operate, conduct, offer, or promote an online sweepstakes game in California. Violations are misdemeanors, punishable by a fine of $1,000 to $25,000, up to one year in county jail, or both, per the chaptered text.

The law carves out two exemptions:

• Licensed gambling enterprises operating under California's Gambling Control Act, and the California State Lottery (section 337o(e)).
• Limited and occasional game promotions that are incidental to bona fide sales of consumer products or services (section 337o(f)) - the classic retail-style marketing sweepstakes.

Who the law reaches, including media affiliates

The prohibition does not stop at operators. A separate clause of section 337o makes it unlawful for "any entity, financial institution, payment processor, geolocation provider, gaming content supplier, platform provider, or media affiliate" to knowingly and willfully support, directly or indirectly, the operation, conduct, or promotion of an online sweepstakes game in California.

The "knowingly and willfully" standard matters: liability attaches to deliberate support, not accidental contact with the industry. But the express inclusion of media affiliates puts review sites, streamers, and marketing partners inside the statute's reach - not just the platforms themselves.

The key dates

• February 19, 2025: AB 831 introduced in the Assembly (bill history).
• October 11, 2025: approved by the Governor and filed with the Secretary of State as Chapter 623, Statutes of 2025.
• January 1, 2026: Penal Code 337o became operative, per the codified section.

What has changed in the market

California was one of the earliest states with a statutory ban on the books, and the broader US market has contracted sharply since. VGW - operator of Chumba Casino and Global Poker - now restricts play in 16 US jurisdictions, compared with five at the end of 2024.

The closure wave has continued through 2026. VGW announced on July 28, 2026 that it will close LuckyLand Slots: gameplay ends August 24, 2026, and Sweeps Coin redemption requests must be submitted before September 14, 2026. The Money Factory permanently ceased operations on August 9, 2026, per its own site notice. CoinFrenzy announced the week of August 10, 2026 that players can use or redeem balances before September 25, 2026.

One caution on cause and effect: none of these operators named California specifically in its closure notice, and press coverage of the wave has pointed to bans across multiple states, including New York (effective December 5, 2025), Tennessee (May 22, 2026), Maine (July 29, 2026), Louisiana (August 1, 2026), and Oklahoma (November 1, 2026). California's law is one piece of a national shift, but it has now been operative longer than most of them.

The bottom line

If you are in California, dual-currency sweepstakes casinos have been illegal to operate, offer, or promote since January 1, 2026 - not from some future date in 2027. Any coverage promising a 2027 deadline or a 90-day off-ramp is describing provisions that do not exist in Chapter 623. The chaptered text and the codified section are both public, and both say the same thing.
