Stake.us is still one of the best-built sweepstakes casinos operating in the US, and it is available to fewer Americans than at any point since it launched. Both things are true at once, and which one matters more depends entirely on your ZIP code. The product has not gotten worse in 2026. The map has.

Roughly 23 states are now off the board. The 2026 legislative session took several of them away in a matter of weeks, and Oklahoma is scheduled to follow on November 1, 2026. If you are in Texas, Florida, Georgia, or Ohio, this is a straightforward recommendation with a caveat about pending bills. If you are in Illinois, Indiana, Maine, Tennessee, Louisiana, or Iowa, this review is largely a historical document. All details checked August 3, 2026.

What changed in 2026

This is the section that matters most, and it is the reason the older version of this review was retired. Stake.us did not change its terms much this year. It changed its footprint.

  • California went dark January 1, 2026 when AB 831 took effect. That was the single largest market loss in the category.
  • Illinois: the Illinois Gaming Board said in February 2026 it had reason to believe Stake.us was running an illegal online casino, and sent cease-and-desist letters to Stake.us and other operators. Stake.us notified Illinois players it would end operations there on May 19, 2026, moving accounts to redeem-only mode.
  • Tennessee: HB 2136 took effect May 22, 2026, following cease-and-desist letters from the state attorney general.
  • Louisiana: HB 53 and HB 883, signed by Gov. Landry in May 2026, folded sweepstakes operators into the state's racketeering statute. Louisiana is out.
  • Indiana: HB 1052, effective July 1, 2026.
  • Maine: LD 2007, signed by Gov. Mills, effective July 2026.
  • Iowa: Gov. Reynolds signed SF 2289 on May 15, 2026, giving the Racing and Gaming Commission cease-and-desist and injunctive authority. Operators began restricting Iowa ahead of the July 1 enforcement date.
  • Oklahoma: SB 1589 was vetoed by Gov. Stitt on May 7, 2026, then overridden by the legislature. It takes effect November 1, 2026. Oklahoma players still have access as of this writing, but should plan around that date.

There is also live litigation. A federal class action filed in Virginia in January 2026 names Stake.us alongside Drake and Adin Ross with racketeering-style claims, and a separate class action alleges illegal operation in Minnesota. No settlement has been announced. None of this affects your ability to play today in an open state, but it is a real overhang on the brand, and it is worth knowing before you put money in.

The meaningful open markets are Texas, Florida, Georgia and Ohio, which together are why the platform still has scale. Bills are pending in Florida and Ohio, and further legislation is moving in Minnesota, Maryland, Virginia, Mississippi and Washington DC. Treat this list as a snapshot, not a permanent state of affairs, and re-check before you buy a coin package.

Geolocation is enforced on physical presence, not residency. A Texas resident sitting in a California airport cannot play.
